Terms & Conditions

Artikel 1 — Definities

1. Beau Home: the private limited company Beau Home B.V., established at Roermondseweg 109 (6004 AR) in Weert (Chamber of Commerce 71304703, VAT NL858662127B01, tel. 0495-540079, [email protected]).
2. Customer: the party that enters into an agreement with Beau Home or for whom Beau Home makes an offer, performs delivery or provides services. A distinction is made between business customers and consumers.
3. Custom work: products made to the customer's specifications that are not prefabricated (shape, size, colour, material) or are clearly intended for a specific person.

Artikel 2 — Toepasselijkheid

1. These terms apply to all offers, quotes, agreements and services. In case of conflict, the provisions of the agreement take precedence.
2. In case of ambiguity, a provision is interpreted 'in the spirit' of these terms.
3. If Beau Home does not always require strict compliance, this does not mean that the provisions do not apply.

Artikel 3 — Offerte

1. Offers and quotes are valid for 7 days, unless otherwise stated.
2. Errors such as incorrect price information and typing mistakes are not binding.

Artikel 4 — De overeenkomst

1. The agreement is established by the customer's acceptance of the offer and the signing of the order confirmation.
2. The order confirmation is leading; check it within 3 days for errors.
3. Offers and promotions are temporary and do not give the right to a price reduction after the closing date.
4. Changes are only valid if agreed in writing.

Artikel 5 — Herroepingsrecht / beëindiging

1. Het merendeel van de geleverde producten betreft maatwerk (tafels, salontafels, kasten, tv-meubelen, gestoffeerde meubels op maat). Het herroepingsrecht is hierop niet van toepassing — deze producten kunnen niet geretourneerd worden.
2. Bij beëindiging met wederzijds goedvinden bedraagt de schadevergoeding 30% van de koopprijs (50% indien al geïnformeerd over deellevering).

Artikel 6 — Intellectueel eigendom

Beau Home retains copyright and all rights to offers, designs, images, drawings and (sample) models. Reproduction or disclosure without permission is not allowed.

Artikel 7 — Levering en leveringstermijn

1. Levering vindt plaats op het door de afnemer opgegeven adres, op een door Beau Home in overleg te bepalen moment. Een overeengekomen levertijd is nooit een fatale termijn.
2. Levering is op de begane grond — andere locaties vooraf bespreken.
3. Het risico van beschadiging of verlies gaat over op de afnemer op het moment van levering.

Artikel 8 — Betaling

1. Payment is made before or upon delivery, unless otherwise agreed.
2. In case of late payment, statutory interest and any collection costs are due.
3. Ownership only transfers after full payment.

Artikel 9 — Garantie en klachten

1. Delivered products carry a 24-month warranty on manufacturing defects, unless otherwise agreed.
2. The warranty is void in case of improper use, careless handling or abnormal conditions (moisture, heat, lack of maintenance).
3. Complaints do not suspend the payment obligation.

Artikel 10 — Aansprakelijkheid

1. Beau Home is solely liable for direct damages caused by intent or gross negligence.
2. Liability is limited to the amount paid out by the insurer, or to the amount paid by the customer.
3. Beau Home is never liable for indirect or consequential damages.

Artikel 11 — Overmacht

Onder overmacht valt onder meer: natuurgeweld, oorlog, pandemieën, blokkades, stakingen, verkeersstoringen, storingen in elektriciteit, internet of telecom, en vertragingen bij toeleveranciers.

Artikel 12 — Toepasselijk recht en geschillen

1. Dutch law applies to all legal relationships.
2. Disputes are submitted to the competent court in the district where Beau Home is established.

Artikel 13 — Slotbepalingen

1. Indien een bepaling ongeldig is, blijven de overige bepalingen van kracht.
2. Beau Home behoudt zich het recht voor deze voorwaarden te wijzigen — wijzigingen worden tijdig gecommuniceerd.
